Welcome to risingempire. These Terms of Service ("Terms") govern your use of our website, platform, and services provided by risingempire SARL, a company registered in Luxembourg with registration number RCSB976431 and VAT number LU97253682.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access our services. These Terms apply to all visitors, users, and others who access or use our services.

Description of Services

risingempire provides e-commerce customer journey analytics platforms and related services designed to help businesses understand and optimise their customer interactions. Our services include but are not limited to analytics dashboards, customer journey mapping, conversion tracking, and related consulting services.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of our services without notice or liability.

User Obligations

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations, including but not limited to data protection and privacy laws.

You agree not to use our services to transmit, distribute, or store material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. You also agree not to attempt to gain unauthorised access to our systems, interfere with our services, or use our services in any way that could damage or impair their functionality.

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

The risingempire platform, including all software, technology, designs, graphics, text, images, and other content, is the exclusive property of risingempire or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services for their intended purpose. This licence does not include any right to resell, redistribute, or create derivative works based on our services or content.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of our software, unless laws prohibit those restrictions or you have our written permission.

Payment and Subscription Terms

Certain features of our services may require payment of fees. All fees are exclusive of taxes, and you are responsible for paying all applicable taxes associated with your use of our services.

For subscription services, fees are billed in advance on a recurring basis. You authorise us to charge your payment method for the applicable fees. If we are unable to process your payment, we may suspend or terminate your access to paid features.

You may cancel your subscription at any time, but cancellations will take effect at the end of your current billing period. No refunds will be provided for partial periods unless required by applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, risingempire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claims arising out of or relating to these Terms or our services shall not exceed the amount you have paid to risingempire in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. While we strive to provide accurate and reliable analytics, we do not guarantee the accuracy, completeness, or reliability of any data or insights provided through our services.

Indemnification

You agree to indemnify, defend, and hold harmless risingempire, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Luxembourg, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Luxembourg, and you consent to the jurisdiction of such courts.

If you are a consumer resident in the European Union, you also have the right to bring proceedings in the courts of your country of residence, and these Terms do not affect any mandatory consumer protection rights that may apply to you under the laws of your country of residence.

Termination

You may terminate your account and stop using our services at any time. We may also terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If your account is terminated, we may delete your data after a reasonable period, unless we are required to retain it by law or for legitimate business purposes.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, in some cases, we may provide additional notice such as email notification.

Your continued use of our services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue your use of our services.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and risingempire concerning our services and supersede any prior agreements.
